Welcome to Fanatic Angler! The terms “we”, “us”, and “our” refer to Fanatic Angler. We operate this store and website (the “Services”). Fanatic Angler is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) govern your use of the Services. By visiting or using our store, you agree to be bound by these Terms and our Privacy Policy and Return Policy. If you do not agree, you may not use the Services.
1. Access and account
You must be at least 18 years old to create an account or place an order. If you are under 18, a parent or legal guardian must place the order on your behalf. You are responsible for keeping your account secure. Do not transfer or sell your account.
2. Our products
We try to describe products accurately, but colors and appearance may vary by device. Fanatic Angler products are produced and fulfilled by a third-party partner. From time to time, our fulfillment partner may make changes to materials, specifications, or production methods. These changes are outside of our control and may result in minor variations in quality, color, sizing, or availability compared to product descriptions or images on our website. Minor variations are not considered defects.
If you believe your item is defective, damaged, or significantly different from what was described, you must notify us at support@fanaticangler.com within 14 days of delivery. This allows us to work with our fulfillment partner to review your claim and, if appropriate, arrange a replacement at no additional cost.
3. Orders
Placing an order is an offer to purchase. Orders are only accepted once we confirm payment and acceptance. We may refuse or cancel any order. Cancellations and returns follow our Return Policy. Products are for personal use only and may not be resold, redistributed, or used for commercial purposes without our prior written consent.
4. Prices and billing
Prices are subject to change without notice. Taxes, shipping, handling, customs, or import charges may apply. You agree to provide accurate payment details and authorize us to charge all amounts due.
5. Shipping and delivery
Delivery times are estimates, not guarantees. We are not liable for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you when you (or someone you designate) receive the product, except where your local law provides otherwise.
6. Intellectual property
All content and materials on the Services are owned by Fanatic Angler or its licensors and are protected by law. You may use the Services only for personal, non-commercial purposes.
7. Optional tools
Third-party tools may be offered “as is” without warranties or control by us. Use them at your own risk.
8. Third-party links
We are not responsible for third-party sites or content. Review their policies before engaging in transactions with them.
9. Relationship with Shopify
Fanatic Angler is powered by Shopify, but sales are between you and Fanatic Angler. Shopify is not responsible for your purchases.
10. Privacy
Your data is handled under our Privacy Policy and Shopify’s privacy policy. Because the Services are hosted by Shopify, information you submit is also processed by Shopify and may be transferred internationally.
11. Feedback
By submitting reviews or feedback, you grant us a worldwide, royalty-free license to use them. You confirm you own the content and that it complies with these Terms.
12. Errors and inaccuracies
We may correct errors or update information (including pricing and availability) at any time, including after you submit an order.
13. Prohibited uses
You may not use the Services for unlawful, infringing, harmful, or deceptive purposes, or to upload malware, scrape, or bypass security.
Account suspension and refusal of service
We reserve the right to refuse service, cancel orders, suspend accounts, or permanently blacklist customers who engage in abusive behavior, fraudulent activity, repeated violations of our policies, or any conduct that disrupts or harms our Services, staff, or community. Such actions may be taken at our sole discretion, without prior notice.
14. Termination
We may terminate or suspend access at any time. Sections intended to survive termination remain in force.
15. Disclaimer of warranties
Except as required by law, the Services and products are provided “as is” and “as available” without warranties of any kind.
16. Limitation of liability
To the fullest extent permitted by law, Fanatic Angler and its affiliates will not be liable for indirect, incidental, or consequential damages, including lost profits, data, or goodwill. Where liability cannot be excluded, it is limited to the amount you paid for the product giving rise to the claim.
17. Indemnification
You agree to indemnify and hold harmless Fanatic Angler, Shopify, and their affiliates and service providers from claims arising from your breach of these Terms or violation of law.
18. Force majeure
We are not responsible for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, acts of God, strikes, wars, government actions, power outages, internet failures, or similar events.
19. Severability
If any provision is unlawful or unenforceable, the remainder stays in effect.
20. Waiver; entire agreement
These Terms and our posted policies are the entire agreement between you and us, replacing prior agreements.
21. Assignment
You may not assign these Terms. We may transfer our rights and obligations without notice.
22. Governing law
These Terms are governed by the laws of the Netherlands. You consent to jurisdiction in the courts of Amsterdam, The Netherlands.
23. Age restrictions
Our Services are not intended for purchases by individuals under 18. Browsing is permitted, but orders must be placed by a parent or legal guardian. This helps keep ordering and support clear and fair for everyone.
24. Changes to Terms
We may update these Terms by posting a new version with an updated date. Continued use of the Services after changes means you accept them.
